Who develops the plugins and who sells them
The plugins are developed by Antonio Morlino, Via Arrigo Benedetti, 13 - 00159 Roma (RM), Italia, VAT number IT04060650712, email dev@antoniomorlino.com. In the rest of the page I speak in the first person.
Licences are sold by Freemius, Inc., a company based in the United States, as reseller and merchant of record: the purchase contract is concluded with Freemius, which collects the payment, applies VAT, issues the invoice or receipt and handles renewals and refunds. Freemius' terms also apply to the purchase (freemius.com/terms); if a point on this page conflicts with those, this page governs the relationship between you and me.
The data you enter at checkout goes straight to Freemius, which processes it as an independent controller. How I handle the sales data I receive from Freemius is set out in the Privacy Policy.
What they apply to
These terms apply to all paid licences (Pro) of the Lobbit WordPress plugins that I sell through this site, now and in the future, whatever the plugin. The free versions, downloaded from WordPress.org or received from me, follow only the GPL licence and the WordPress.org rules.
When you click a purchase button and complete the payment, you accept these terms in the version published at that moment.
What you buy: GPL licence and annual licence
The plugin code, Pro included, is free software licensed under GNU GPL v2 or later: you can use it, study it, modify it and redistribute it as the GPL allows.
What you buy is an annual licence: a key that, for one year, gives you the Pro updates from the WordPress dashboard and support, on the number of sites stated in the plan you chose (for example 1 site or 25 sites). The licence does not limit the rights the GPL gives you over the code.
You can move the licence from one site to another: deactivate it on the first, from the plugin or from your Freemius account, and activate it on the new one.
Prices, payment and invoice
Prices are those shown on each plugin's page at the time of purchase, in euros and excluding VAT. The Freemius checkout adds the VAT of your country; if you buy with a valid EU VAT number you don't pay it. You can pay by card or PayPal.
The invoice or receipt for the purchase is issued by Freemius and you find it in the confirmation email and in your Freemius account. After payment you receive the licence key and the download link for the Pro version by email.
Duration, renewal and cancellation
The licence lasts one year from the purchase date and renews automatically every year, charged to the payment method you used. The renewal costs what you paid on the first purchase, even if the price on the page has changed in the meantime.
You can cancel the renewal whenever you want from your Freemius account, at no cost and without giving reasons: the licence stays valid until the end of the year already paid for and then you are no longer charged.
When the licence expires
If the licence expires because you cancelled the renewal or because the payment failed, the Pro features stay active on your site: you lose nothing of what you configured. Only the Pro updates and support stop, and they come back when you renew the licence.
Without updates the plugin stays at the installed version: security fixes and compatibility with new versions of WordPress and PHP come only with an active licence.
Refund and right of withdrawal
Within 14 days of purchase or renewal you can request a refund, no explanation needed:
- if the licence has not yet been activated on any site, I refund the full amount paid;
- if the licence has already been activated on at least one site, I refund 50% of the amount paid, because the plugin has been downloaded and used and the payment has already incurred costs.
To request a refund, write to me from the contact form or at dev@antoniomorlino.com, stating the email used for the purchase. The refund goes back to the same payment method, through Freemius; with the refund the licence is cancelled and updates and support stop. After 14 days no refunds are available.
If you are a consumer, the law gives you 14 days to withdraw from online purchases. For digital content, however, the right of withdrawal no longer applies once supply has begun, if you requested it before the deadline and agreed to lose the right of withdrawal (art. 59, paragraph 1, letter o, of the Italian Consumer Code). In the Freemius checkout you give exactly this consent: you ask to receive the Pro immediately and acknowledge that, by downloading it, you waive the right of withdrawal. The refund described above is therefore a guarantee I offer in addition to your statutory rights.
Support
With an active licence you get support on the plugin you bought. You request it from the plugin's «Ask for support» button, which opens the contact form already filled in with the site details, or by writing to dev@antoniomorlino.com. I reply in Italian or English.
I reply within 48 hours, counting working days only (Monday to Friday, excluding Italian public holidays). That is the time for the first reply, not for the solution: resolution times depend on the problem.
Support includes:
- help with installing, activating and configuring the plugin;
- answers to questions about how to use its features;
- the analysis of plugin malfunctions and their correction, delivered with an update.
It does not include:
- custom developments and new features built for a single site;
- changes to the theme, to other plugins or to the site code;
- resolving conflicts caused by themes, plugins or third-party services, as well as the diagnosis that identifies them;
- the configuration of the server, the hosting, the caches or the CDNs;
- the site contents and the third-party services the plugin uses with an account of yours, for example AI translation services, with their costs.
I can carry out this work separately, with a quote. If a plugin comes to you as part of one of my support services, for example Lobbit Hardening installed and configured on your site, support follows the terms of that service.
Limitation of liability
The plugins are provided «as is», as the GPL requires, without warranties beyond those the law does not allow to be excluded. I develop and test them carefully, but every WordPress site is different: before installing or updating a plugin, back up the site and, if you can, test it on a copy.
Except in cases of wilful misconduct or gross negligence, my liability for damages related to the licence or the use of the plugin is limited to the amount you paid for the licence in the 12 months before the event. I am not liable for indirect damages, such as lost profits, data loss or site downtime, nor for problems caused by themes, plugins, hosting or third-party services.
If you are a consumer, the rights granted to you by law that cannot be limited remain unaffected, including the conformity guarantee for digital content.
Changes to the terms
I may update these terms, for example when a new plugin arrives or a legal rule changes. The date at the top of the page indicates the latest version. Changes apply to new purchases and, for licences already active, from the next renewal: if they do not suit you, you can cancel the renewal.
Applicable law and jurisdiction
These terms are governed by Italian law. If you buy as a professional or a company, the court of Rome has exclusive jurisdiction over any dispute. If you are a consumer, the court of the place where you reside has jurisdiction and the mandatory protections of the law of your country remain unaffected.
For any problem, write to me first at dev@antoniomorlino.com: it is almost always solved with one reply.
